Alkuins erbrechtliche Expertise für Karl den Großen?

Abstracts

In the centre of attention is the document Capitula quae tali convenit in tempore memorari, which was written anonymously and handed down in two manuscripts, situated in the context of letters by Alcuin. It answers in 12 capitula the requests of a royal addressee, saying in which circumstances the Frankish common law, according to which all sons were given an equally large share in the reign, could be invalidated. In accordance to the common assumption – except for D. A. Bullough – that Alcuin is the author, it was generally thought that Charlemagne was the consignee. The exact analysis of the content suggests however, that the document has to be classified belonging to Charles the Bald and therefore has to be applied to his son Louis the Stammerer. The king could have commissioned the document in preparation for the gathering in Quierzy in 877, in order to settle the succession in the empire before his second journey to Italy. A possible author could be – because of his political function – Hincmar of Reims, but the document will not really suit to his style and choice of words. For that reason it is still wide open who the author is; all traces were very well covered because of the explosive nature of the document. Only that much is certain, that the capitula was never included in a capitulary.
