Hereinafter referred to as the “Publisher”, on the other part.
Preamble
The Publisher publishes a periodical entitled Revue Européenne des Migrations Internationales (REMI), under the electronic ISSN number 1777-5418, hereinafter called the “Journal”, which distribution and marketing have been entrusted to OpenEdition Journals and Cairn. The Publisher entrusts the Editorial Board of the Journal with representing it regarding contributors or authors and with editing the Journal.
The Journal is distributed electronically on the platforms OpenEdition Journals (https://journals.openedition.org/remi) and Cairn (https://www.cairn.info/revue-europeenne-des-migrations-internationales.htm). The articles are in open access. The Journal is published under the terms of the Creative Commons Attribution - 4.0 International (CC BY 4.0) license.
The Author submitted to the Journal an article entitled ………………………………………………………………..…………………………………….. (hereinafter called the “Contribution”) for its publication in the Journal.
When submitting it to the Journal, the Author warranted that the Contribution had not been submitted for publication to any other periodical, or that any previous submission of the Contribution to another publication has been withdrawn.

Definitions
“Final version of manuscript accepted for publication” is the version whose content has been scientifically validated and edited (standardised, harmonised, and structured).
“Publisher’s PDF” is the final version of the manuscript accepted for publication after layout by the Publisher.
Art. 1 – Purpose of the agreement
The Author grants the Publisher, free of charge and on a non-exclusive basis, the rights to exploit their Contribution in digital format in the Journal. Pursuant to Article L122-1 of the French Intellectual Property Code, the rights granted hereunder include the right of reproduction and the right of communication to the public (see Article 3).
Art. 2 – Author’s obligations
The Author undertakes to deliver to the Publisher, within the requested timeframe, the final and full version of the manuscript, carefully proofread and prepared in accordance with the recommendations, which can be found on the Journal’s website (https://journals.openedition.org/remi/5848). The Author shall deliver his or her the Contribution in text file format (.doc, .docx, .odt format) together with any image files, when applicable (.jpeg, .png, .tiff format).
The Author warrants that the Contribution is original and unpublished. If the Contribution include extracts of texts or illustrations from other works, the Author shall provide the Publisher with all necessary reproduction authorisations for a proper publication.
The Author also warrants that the Contribution does not contain any material that violates legal provisions or could lead to liability of the Publisher, and guarantees the Publisher the full and peaceful exercise of the granted rights against all disturbances, claims and evictions of any kind.
Art. 3 – Rights granted to publish in digital form
The Author grants to the Publisher the right to exploit the Contribution in digital form, including:
- the right to reproduce the Contribution and its translations, in the Journal or separately from the Journal, by means of electronic files in any existing or future format such as HTML, XML, PDF, ePub, on all existing or future digital storage media such as Internet servers, USB sticks, hard disks, memory cards, tablets, computers, e-readers, mobile phones, electronic paper (e-paper), enabling the temporary or permanent storage of digital data;
- the right to present the Contribution and its translations, in the Journal or separately from the Journal, in order to ensure its communication to the public, free of charge or for a fee per unit or by subscription, by all current and future means, including through the Internet, networks of any legal entities governed by public or private law such as firms, libraries, educational and research institutions, so it could be accessed online and downloaded using a distant or local computer connection
The Author also grants the Publisher to publish the Contribution in open access under the Creative Commons CC BY 4.0 license, for all the types and means of exploitation mentioned hereabove, which means all people interested shall have the right to reuse all or part of the Contribution without asking Author’s permission, under the condition to credit the Author (BY).
Taking into consideration the context of the Contribution’s publication, intended to spread scientific knowledge and research findings (article L.123.6 of Educational code), and in accordance with Article L.122-7 of the French Intellectual Property Code, the Author explicitly grants these rights to the Publisher on a free basis.
The Publisher may exercise these rights solely or through third parties; in that case the Publisher undertakes to inform the Author of any such grant of right. As this grant is made on a non-exclusive basis, the Author may subsequently publish the Contribution with another publisher, provided that the full bibliographic reference of the first publication in the Journal is indicated.
Art. 4 – Photographs and images
The Author retains full copyright in any photographs and images that he or she creates, produces, and incorporates into the Contribution, regardless of whether the Contribution is spread in open access under the Creative Commons CC BY 4.0 license.
The spread of the Contribution in open access under the Creative Commons CC BY 4.0 license has no effect on the copyright in such photographs and images.
Any reproduction or representation of photographs or images of which the Author is not the creator must comply with the provisions of the French Intellectual Property Code, in particular those relating to copyright.
Art. 5 – Duration and scope of the grant of rights
The Author grants the Publisher the right to exploit the Contribution in the Journal on a non-exclusive basis, in all languages and in all countries, for the duration of literary and artistic property rights under French and foreign laws, and current or future international conventions, including any extensions that may be added to this duration, and by any existing or future means.
Art. 6 – Publisher’s obligations
The Publisher undertakes to publish the Contribution in the Journal within an average period of 20 months since the delivery of it by the Author.
The Publisher shall ensure that the Contribution meets the standards of academic publication and shall bring editing added value (spell and typographical proofreading, verification and standardisation of references, structuring, review and processing of iconography).
The Publisher undertakes to submit an edited proof of the Contribution to the Author for approval of publishing in a digital form.
The Publisher undertakes to provide the Author with an electronic offprint, as soon as the Contribution is published.
On demand, the Publisher also undertakes to provide the Author with the final PDF version of the manuscript accepted for publication, so that the Author could exercise his or her right to deposit this version in an open archive or an institutional repository, in accordance with Article L.533-4 of the French Research Code (Law for a Digital Republic of 2016 – see Article 7).
Art. 7 - Open archive policy
As the rights to publish the Contribution is granted by the Author to the Publisher on a non-exclusive basis, the Author is free to deposit the final version of the manuscript accepted for publication in an open archive (e. g. HAL) or an institutional repository (a sustainable platform accessible by everyone without the inscription) under the Creative Commons license of his or her choice, at any time, including upon publication of the Contribution in the Journal, under the condition, however, to give the full bibliographic reference of the publication in the Journal.
Academic social networks (such as ResearchGate or Academia.edu) are not considered open archives or institutional repositories.
The Publisher authorises the Author to post the Publisher’s PDF in an open archive or an institutional repository as soon as the Contribution is published under the condition, however, to give the full bibliographic reference. The Publisher authorises the Author to apply the CC BY 4.0 license.
Art. 8 - Governing law and settlement of disputes
The present agreement shall be governed by French law. Any dispute arising from this agreement that shall not be settled out-of-court shall be subject to the jurisdiction of the competent courts.
