Université de Poitiers, owner of the Revue Européenne des Migrations Internationales (REMI), hereafter called the “Journal”, represented by its current President Virginie Laval by delegation of signature to the head of the Maison des Sciences de l'Homme et de la Société de Poitiers (MSHS), on the other part.

Preamble

The Journal publishes a Periodical called Revue Européenne des Migrations Internationales (REMI), under the electronic ISSN number 1777-5418, hereinafter called the “Periodical”. The Journal entrusted OpenEdition Journals and Cairn with its distribution and commercialisation.

The Revue Européenne des Migrations Internationales is distributed electronically on the platforms OpenEdition Journals (https://journals.openedition.org/remi) and Cairn (https://www.cairn.info/revue-europeenne-des-migrations-internationales.htm). The articles are in open access after a 1-year embargo period. The REMI is published under licence under the Creative Commons Attribution - 4.0 International (CC BY 4.0).

The Author submitted to the Journal an article entitled …………………….………….………….………….….………….………….………… (hereinafter called the “Work”) for its publication in the Revue Européenne des Migrations Internationales.

When submitting the Work to the Journal, the Author gave the warranty that the Work had not been submitted for publication to any other Periodical, or that if the Work had already been submitted to another Periodical, the Author requested that the reading process of the Work be interrupted.

Definitions

“Final version of manuscript accepted for publication” is the version of the Work, the content of which has been scientifically validated and edited (standardised, harmonised, and structured).

The “Publisher’s PDF” is the final version of the manuscript accepted for publication after the editing by the Publisher.

Art. 1 – Purpose of the agreement

The Author grants to the Journal the non-exclusive right to publish the Work in digital format.

Art. 2 – Author’s obligations

The Author undertakes to deliver to the Journal, within the requested time frame, the full and final version of the manuscript, thoroughly reread and developed in accordance with the recommendations, which can be found on the REMI's website. (https://journals.openedition.org/remi/5848). The Author shall deliver his or her Work both in text file (.doc, .docx, .odt format) and in PDF file and shall enclose the image files when appropriate (.jpeg., .png, .tiff. format at 300 dpi).

The Author warrants that the Work is original. Should the Work include excerpts of texts or images from other works, the Author shall forward to the Journal all the authorisations required for a proper publication.

The Author also warrants that the Work contains nothing that violates legal provisions or could lead to liability of the Journal; the Author also warrants to the Journal the full and peaceful exercise of the granted rights against all disturbances, claims and evictions of any kind.

Art. 3 – Rights granted to publish in digital form

The Author grants to the Journal the right to reproduce, perform and modify the Work in digital form including:

  • the right to reproduce the Work and its translations, in the Periodical or separately from the Periodical, by means of electronic files in any current or future format such as HTML, XML, PDF, e-Pub, on all current and future digital storage media such as web servers, USB keys, hard disks, storage cards, tablets, computers, e-book readers, smartphones, e-paper i.e., electronic paper, likely to store digital data momentarily or permanently;

  • the right to present the Work and its translations, in the Periodical or separately from the Periodical, in order to ensure its communication to the public, free of charge or for a fee per unit or by subscription, by all current and future means, including through the Internet, networks of any legal entities governed by public or private law such as firms, libraries, educational and research institutions, so it could be accessed online and downloaded using a distant or local computer connection;

The Author also grants the Journal the right to publish the Work in open access under Creative Commons license CC BY 4.0, for all types and means of exploitation mentioned hereabove, which means that all people interested shall have the right to reuse all or part of the Work without asking Author’s permission, under the condition to credit the Author (BY).

Taking into consideration the context of the Work's publication, intended to spread scientific knowledge and research findings (article L.123.6 of Educational code) and in accordance with article L.122-7 of the Intellectual property code, the Author explicitly grants these rights to the Journal on a free basis.

These rights are granted on a free and non-exclusive basis for all countries and in all languages, for the duration of copyright according to French law, foreign laws and current or future international treaties including any extension that may be made to such duration and by any current and future means.

The Journal may exercise these rights solely or through third parties; in that case the Journal undertakes to inform the Author of any such grant of right. As the Author grants these rights to the Journal on a non-exclusive basis, he or she is entitled to publish the Work later on with another publisher provided the full bibliographic reference of the Work’s first publication in the Revue Européenne des Migrations Internationales.

Art. 4 – Journal’s obligations

The Journal undertakes to publish the Work in the Revue Européenne des Migrations Internationales within 20 months since the delivery of the Work by the Author.

Beforehand, the Journal shall ensure that the Work meets the standards of academic publication and shall bring editing added value (spell-and typographical checking, bibliography verification and standard setting, structuration of the text, iconography check and processing). hypertext links.

The Journal undertakes to submit a layout proof of the Work to the Author for approval, which the Author shall return with the statement “Pass for press” if satisfied. Should the Journal publish the Work both in print and digital format, the “Pass for press” statement given by the Author for the print form shall also be valid for the digital form provided the print and the digital forms are similar (apart from possible add-ons specific to the digital form such as hypertext links.

The Journal undertakes to submit an edited proof of the Work to the Author for his or her approval of publishing in a digital form.

On demand, the Journal also undertakes to provide the Author with the final PDF version of the manuscript accepted for publication, so that the Author could exercise his or her right to deposit this version in an open archive or an institutional repository, in accordance with article L533-4 of the Research Code (The French Bill for a Digital Republic – see article 5).

Art. 5 – Open archive policy

As the right to publish the Work is granted by the Author to the Journal on a non-exclusive basis, the Author is free to post the final version of the manuscript accepted for publication in an open archive (e. g. HAL) or an institutional repository (a sustainable platform accessible by everyone without the inscription), under the Creative Commons licence on his or hers choice, as soon as he or she wishes, including upon the publication of the Work in the Revue Européenne des Migrations Internationales, under the condition, however, to give the full bibliographic reference of the publication in the Revue Européenne des Migrations Internationales.

Academic social networks (such as ResearchGate or Academia.edu) are not open archives or institutional repositories: The Work should be posted in an open archive or an institutional repository, especially for sustainability reasons.

The Journal authorises the Author to post the Publisher's PDF in an open archive or an institutional repository upon the beginning of the distribution of the Work in an open access on the Cairn website (= end of the embargo period), under the condition, however, to give the full bibliographic reference of the publication in the Revue Européenne des Migrations Internationales. The Journal authorises the Author to apply the licence CC BY 4.0.

Art. 6 – Governing law and settlement of disputes

The present agreement shall be governed by French law. Any dispute arising from this agreement should be tried to be solved through a mediation procedure before any appeal to the courts.
